This is why I always take my motors for their MOT to a garage/dealer that specialises in that marque.

Aneasy example from my Nissan days - Petrol Primeras up to chassis number 380000 are exempt from the cat test, and would fail if they went anywhere else.  The ministry issues hundreds, perhaps thousands, of bulletins (exceptions, mainly) each year and it's impossible for everyone to keep up to date with all of them, but dealers always remember the ones that apply to them.

And surprise surprise, a Toyota fails it's MOT on emissions, yet a Toyota dealers says there's nothing wrong with it...

As for the damage - you put the car in the care of garage number 1, and regardless of where they themselves then too it, it remains their responsibility until they return the car to you.

Over here in Northern Ireland, we have government MOT centres where you have to take your car for its mot (there are no backstreet mot garages here). For your first MOT its when the car is 4 years old here but 3 years in England. Anyway, when you go to one of the centres they are like a long warehouse, where you start at one end and finish at the other with different testing stages in between.
1st they test the emissions and lights/horn/wipers etc. They test headlight allignment here too.
2nd the car is driven forward to four plates on the ground that move up and down to test shock absorbers.
3rd the car is driven forward on to the rollers and the front brakes are tested, then driven forward and the rear brakes are tested. Then they test the handbrake.
4th stage is the car is driven onto a lift and hoisted up, then the machine moves the wheels to test for worn joints on all wheels. The tester also checks condition of exhaust and floorpan for rust etc.
When the car is driven off the lift the test is over and you are given your pass or fail certificate.
